شروط الاستخدام

١. قبول الشروط والأهلية

CamelShot خدمة للأعمال. باستخدامها تقر بأن عمرك 18 عامًا فأكثر، وأنك تستخدمها لنشاطك التجاري، وأنك مخوّل بالموافقة على هذه الشروط نيابةً عن الجهة التي تمثلها إن وُجدت.

٢. طبيعة الخدمة

يولّد CamelShot أفكارًا ونصوصًا وإعلانات لمنتجاتك، مثل الصور الإعلانية ومقاطع الفيديو القصيرة، بالاعتماد على تقنيات الذكاء الاصطناعي، انطلاقًا من وصف المنتج وصوره واختياراتك. تختلف النتائج من محاولة لأخرى، وقد لا تطابق توقعاتك في كل مرة، ولا نضمن أداءً إعلانيًا أو مبيعات معيّنة.

٣. الرصيد والباقات والمدفوعات

• الرصيد هو وحدة الاستخدام، وتختلف تكلفة كل عملية حسب نوعها، مثل عدد الصور الإعلانية أو مدة الفيديو. نعرض تكلفة كل عملية قبل تنفيذها.
• رصيد الباقة يُضاف مع كل فاتورة مدفوعة ويُعاد ضبطه عند نهاية فترة الاشتراك، ولا يُرحَّل. في الباقات السنوية يُضاف الرصيد شهريًا على مدار السنة.
• الرصيد المشترى من الحزم لا ينتهي، ويُستخدم بعد نفاد رصيد الباقة.
• الترقية تُطبَّق فورًا ويُخصم فرق السعر المتبقي من الفترة. التخفيض يُطبَّق عند نهاية الفترة المدفوعة، وتحتفظ بباقتك ورصيدك حتى ذلك الحين.
• إذا فشل إخراج صورة أو فيديو لسبب من جهتنا، يُعاد الرصيد المخصوم تلقائيًا.
• الأسعار بالريال السعودي وتخضع لضريبة القيمة المضافة حيثما تنطبق. تُعالج المدفوعات عبر Stripe، ويتجدد الاشتراك تلقائيًا ما لم تلغه من بوابة الفوترة قبل نهاية الفترة.
• الرصيد المستخدم غير قابل للاسترداد نقدًا. عند إلغاء الاشتراك تستمر خدمتك حتى نهاية الفترة المدفوعة.

٤. محتواك وحقوقك

تحتفظ بملكية ما ترفعه من صور ونصوص، وتمنحنا ترخيصًا محدودًا لاستضافته ومعالجته وإرساله إلى مقدّمي نماذج الذكاء الاصطناعي بالقدر اللازم لتقديم الخدمة وحمايتها وتحسينها. تقر بأنك تملك الحق في استخدام ما ترفعه، بما في ذلك صور المنتجات والعلامات التجارية.

ما يولّده CamelShot لك تستطيع استخدامه تجاريًا في إعلانات نشاطك إلى الحد الذي يسمح به القانون وشروط مقدّمي النماذج، وتظل مسؤولًا عن مراجعته قبل نشره. لا نستخدم إعلاناتك في تسويقنا دون موافقتك.

٥. الاستخدام المقبول

• لا تنشئ إعلانات مضللة أو مخالفة للقانون أو لأنظمة الإعلان في بلدك أو لسياسات المنصات التي تنشر عليها.
• لا تستخدم صور أشخاص حقيقيين أو أصواتهم أو علامات الغير دون تصريح.
• لا تولّد محتوى يحرّض على الكراهية أو العنف، أو محتوى جنسيًا، أو يروّج لمنتجات محظورة.
• لا تحاول تعطيل الخدمة أو تجاوز حدود الاستخدام أو الوصول إلى أنظمة أو بيانات الآخرين، ولا تعيد بيع الخدمة أو تستخرج نماذجنا أو برومبتاتنا.

٦. حدود الذكاء الاصطناعي ومسؤوليتك

قد تحتوي المخرجات على أخطاء أو تفاصيل غير دقيقة أو عناصر مرئية غير واقعية. راجع كل إعلان قبل نشره، وتأكد من مطابقته لمنتجك الحقيقي ولأنظمة الإعلان والاستهلاك المعمول بها. أنت المعلن والمسؤول عمّا تنشره.

٧. خدمات الغير

تعتمد الخدمة على مقدّمين خارجيين للدفع وتسجيل الدخول والتخزين ونماذج الذكاء الاصطناعي، وقد يخضع استخدامك لبعض الميزات لشروطهم. لسنا مسؤولين عن انقطاع خدماتهم أو تغيّرها، لكننا سنبذل جهدًا معقولًا لتقليل الأثر.

٨. الإيقاف والإنهاء

يمكنك التوقف عن استخدام CamelShot أو حذف حسابك في أي وقت. وقد نعلّق وصولك أو ننهيه إذا خالفت هذه الشروط، أو وُجد خطر أمني أو قانوني، أو توقفت الخدمة. عند الإنهاء بسبب مخالفة جوهرية يسقط الرصيد المتبقي، وفي غير ذلك نتيح لك تصدير إعلاناتك خلال مدة معقولة.

٩. إخلاء المسؤولية وحدودها

تُقدّم الخدمة «كما هي» و«حسب توفرها» إلى الحد الذي يسمح به القانون. لا نضمن دقة كل مخرج أو ملاءمته أو أن تعمل الخدمة دائمًا من دون انقطاع.

إلى الحد الأقصى الذي يسمح به القانون، لا نتحمل المسؤولية عن الأضرار غير المباشرة أو العرضية أو الخاصة، أو عن فقد الأرباح أو البيانات. ولا تتجاوز مسؤوليتنا الإجمالية عن أي مطالبة المبالغ التي دفعتها لنا خلال الاثني عشر شهرًا السابقة للواقعة. ولا تستبعد هذه الشروط أي مسؤولية لا يسمح القانون باستبعادها.

١٠. القانون الواجب التطبيق

تخضع هذه الشروط للقوانين المعمول بها في بلد تسجيل الشركة المشغّلة لخدمة CamelShot، المبيّن في فاتورتك، مع مراعاة أي حقوق إلزامية يمنحها لك قانون بلد إقامتك.

قد نحدّث هذه الشروط من وقت لآخر. سننشر النسخة الجديدة هنا ونحدّث تاريخ السريان، وسنخطرك بالتغييرات الجوهرية قبل سريانها. استمرارك في استخدام الخدمة بعد ذلك يعني موافقتك عليها. للتواصل: [email protected].

1. Acceptance and eligibility

CamelShot is a service for businesses. By using it you confirm that you are at least 18 years old, that you use it for your business activity, and that you are authorised to accept these terms on behalf of the organisation you represent, if any.

2. The service

CamelShot generates ad concepts, copy, and ads for your products, such as image ads and short videos, using artificial intelligence, based on your product description, photos, and choices. Results vary from one run to the next, may not match your expectations every time, and we do not guarantee any advertising performance or sales.

3. Credits, plans, and payments

• Credits are the unit of use, and the cost of each action depends on its type, such as the number of image ads or the length of a video. The cost of each action is shown before it runs.
• Plan credits are added with each paid invoice and reset at the end of the subscription period. They do not roll over. On yearly plans the allowance is added month by month across the year.
• Credits bought as packs never expire and are spent after plan credits run out.
• Upgrades apply immediately and the remaining difference for the period is charged. Downgrades apply at the end of the paid period, and you keep your plan and credits until then.
• If a render fails for a reason on our side, the deducted credits are returned automatically.
• Prices are in Saudi riyals and subject to VAT where applicable. Payments are processed by Stripe, and subscriptions renew automatically unless cancelled in the billing portal before the period ends.
• Used credits are not refundable in cash. When you cancel, your service continues until the end of the paid period.

4. Your content and rights

You keep ownership of the photos and text you upload, and you grant us a limited licence to host, process, and send them to AI model providers as needed to provide, protect, and improve the service. You confirm you have the right to use what you upload, including product images and trademarks.

You may use what CamelShot generates for you commercially in your own advertising, to the extent permitted by law and by the model providers' terms, and you remain responsible for reviewing it before publishing. We do not use your ads in our marketing without your consent.

5. Acceptable use

• Do not create ads that are misleading or that breach the law, the advertising regulations of your country, or the policies of the platforms you publish on.
• Do not use the likeness or voice of real people, or third-party brands, without permission.
• Do not generate content that incites hatred or violence, sexual content, or promotion of prohibited products.
• Do not disrupt the service, circumvent usage limits, access other people's systems or data, resell the service, or extract our models or prompts.

6. AI limitations and your responsibility

Outputs may contain errors, inaccurate details, or unrealistic visual elements. Review every ad before publishing it, and make sure it matches your real product and complies with applicable advertising and consumer rules. You are the advertiser and are responsible for what you publish.

7. Third-party services

The service depends on external providers for payments, sign-in, storage, and AI models, and your use of some features may be subject to their terms. We are not responsible for interruptions or changes to their services, but we will make reasonable efforts to limit the impact.

8. Suspension and termination

You may stop using CamelShot or delete your account at any time. We may suspend or end your access if you breach these terms, if there is a security or legal risk, or if the service is discontinued. On termination for a material breach, remaining credits are forfeited; otherwise we will let you export your ads within a reasonable period.

9. Disclaimers and limitation of liability

The service is provided "as is" and "as available" to the extent permitted by law. We do not guarantee the accuracy or suitability of any output, or that the service will always run without interruption.

To the maximum extent permitted by law, we are not liable for indirect, incidental, or special damages, or for lost profits or data. Our total liability for any claim will not exceed the amounts you paid us in the twelve months before the event. Nothing in these terms excludes liability that cannot be excluded by law.

10. Governing law

These terms are governed by the laws of the country where the company operating CamelShot is registered, as shown on your invoice, without prejudice to any mandatory rights granted to you by the law of your country of residence.

11. Changes and contact

We may update these terms from time to time. We will publish the new version here, update the effective date, and notify you of material changes before they take effect. Continuing to use the service afterwards means you accept them. Contact: [email protected].
